Chapter 1. General Provisions Article 1 (Purpose) The purpose of these genera terms and conditions is to set forth relevant matters on use conditions and procedures for all services provided by the prior entry system for quarantine information of the Korea Disease Control and Prevention Agency (hereinafter referred to as “System”), and any other necessary matters. Article 2 (Definitions of Terms) The definitions of terms used in these general terms and conditions shall be as follows: 1. A user refers to a person who have access to the system and receive the services provided by the system. 2. Entry refers to entering relevant information on the entry form provided by the system, consenting to the general terms and conditions, and completing use of the services. 3. Quarantine information refers to passport information, PCR test in formation, vaccination information, etc. that a user enters on the system. 4. Entry information refers to a combination of letters and figures given by the system in order to identify users and allow users to use the services. 5. Any term not defined in these general terms and conditions shall be defined in relevant laws or separate general terms and conditions or separate provisions for use with respect to individual services. Article 3 (Effectiveness and Modification of General Terms and Conditions) 1. The system shall provide services to users on the condition that users consent to the provisions of these general terms and conditions. 2. Where there is a reasonable ground to change the system, etc., these general terms and conditions may be modified. If there is a change(s) in these general terms and conditions, it shall be publicly announced without delay. 3. These general terms and conditions modified under Section 2 shall come into effect in the same way as specified in Section 1. 4. If a user continues to use the services after the date when these general terms and conditions as modified come into effect, the user shall be deemed to have consented to these general terms and conditions as modified. Article 4 (Applicable Rules Other Than General Terms and Conditions) 1. The system may make separate general terms and conditions or separate provisions for use by service field. In the event that each of these general terms and conditions conflict with each of provisions for use with respect to content of information, the content of information in each of provisions for use shall prevail for application. 2. With respect any matter not specified in these general terms and conditions, the Framework Act on Telecommunications, the Telecommunications Business Act, the Deliberation Regulation on Information and Communication, the Code of Ethics on Information and Communication, the Program Protection Act, and any other relevant laws shall be applicable. Chapter 2. Provision and Use of Services Article 5 (Formation of User Agreement) 1. A system user agreement shall be formed when a relevant user accepts his or her use by consenting to the provisions of these general terms and conditions through the internet. 2. A user consent to these general terms and conditions refers to the user expression of intent by pressing the button of Consent to these general terms and conditions of the system. Article 6 (Consent to and Protection for Use of Personal Information) 1. Personal information shall be protected under the Act on the Protection of Personal Information by Public Institutions. 2. Personal information of the system shall be collected, used, and protected as follows: 1) For collection of personal information: the system shall collect personal information of users through the information that users provide or occurs for use of the services. 2) Use of personal information: the personal information collected under Section 1 above shall not be revealed or distributed to a third party without a relevant user approval; provided, however, that an exception shall be made where a request is made according to due process as specified in relevant laws or where a relevant user voluntarily discloses the personal information provided by the user to the system, and relevant information including personal information may be provided to other administrative agencies if it is necessary for integrated management of user information between the system and administrative agencies. 3) Protection of personal information: the personal information collected as specified in Section 1 shall be protected by input number, passport number (or date of birth), or e-mail. Therefore, a user shall not let third parties know his or her input number, passport number (or date of birth), or e-mail, and when the user ends the use, he or she must close a relevant window(s) of the web browser. 3. If a user applies for use under these general terms and conditions, the user shall be deemed to have consented to the system use of personal information collected as specified in Section 2 Paragraph 1. Article 7 (Information Security for Users) 1. Users shall be responsible for keeping in secret the information entered from the time when they use the system. Users shall be held responsible for all the results that occur as a result of their using input numbers, passport numbers (or dates of birth), or health condition information, etc. 2. Users shall be responsible for managing all the information of input numbers, passport numbers (or dates of birth), or health condition information, etc. In the event that a user has found that his or her input number, passport number (or date of birth), or health condition information, etc. has been wrongfully used, the user shall immediately report it to the system. A relevant user shall be responsible for all the results that occur as a results of his or her failure to report. 3. Users shall end access to the system accurately whenever they end use of the system. The system shall not be held responsible for damages or losses incurred as a result of a third party using information of a relevant user because the user fails to use the system accurately. Article 8 (Notice for Users) 1. In operating the services, a relevant system manager may post on the system or provide to users or notify users of various information including notices by sending e-mails, etc. 2. As for a notice for unspecified many users, in lieu of individual notices, a relevant system manager may post the content of notice on the bulletin board of the system for not less than one (1) week. Article 9 (Giving and Change of Input Number) 1. The system shall give input numbers when users completes entry as specified in these general terms and conditions. 2. In principle, input numbers may not be changed. Article 10 (Service Use Hours) 1. In principle, service use hours shall be twenty four (24) hours per day, seven (7) days per week unless there is a special trouble on works or technologies of the system. 2. The service use hours of the prior Section may be restricted after a prior notice is provided to users if regular checking or exchange, etc. is required for the system. Article 11 (Suspension of Services and Public Notice of Suspension) 1. The system may restrict or suspend its provision of services where a relevant event has occurred, such as repair, checking, exchange, breakdown of information communication facilities, interruption of communications, works for change of provided services, congestion of service use, etc. 2. Where the system is required to suspend the services under Section 1 above, it shall publicly announce a relevant reason, date and time for system service suspension one (1) week prior to suspension of services; provided, however, that where urgent checking of the system is required or in the event that there is an inevitable ground, such as disk failure, system down, etc. without a relevant system manager’s willfulness or negligence, such a prior notice period may be shortened or omitted, and the system shall not be held responsible for any damage or loss incurred as a result of users’ failure to recognize the content of notices. 3. Where the system is required to suspend the services permanently due to its reasons, it shall give one (1) month prior notice thereof. Article 12 (Restrictions on Use of Services) 1. The system may limit or delete service use without prior notice if a relevant user has violated his or her obligations under Article 16 of these general terms and conditions. 2. The system may restrict service use or delete notices without prior notice if a relevant user engages in each of the following activities: ① Where a relevant user has posted notices that contravene these general terms and conditions or that are found to be commercials, advertisements, obscene, or vulgar; ② Where a relevant user activities are against public order and morals; ③ Where a relevant user activities are concerned or found to be related to criminal activities; ④ Where a relevant user plans or carries out service use for the purpose of hindering national interests or social public interests; ⑤ Where a relevant user misuses a third party input number, passport number (or date of birth), e-mail, etc.; ⑥ Where a relevant user undermines a third party reputations or gives disadvantages to a third party; ⑦ Where a relevant user infringes upon the system or a third party copyrights or other rights; or ⑧ Where a relevant user activities otherwise contravene relevant laws or the use conditions specified in the system. Chapter 3. Duties and Responsibilities Article 13 (Duties of System) 1. The system shall not engage in any activity in contravention of laws and these general terms and conditions, and make efforts to provide the services in stable manner. 2. The system shall not divulge or distribute information on applications and uses of users to any third party without consent of the users; provided, however, that an exception shall be made where there is an investigative purpose for crimes or any other request under procedures specified in relevant laws, and the system may provide relevant information including personal information to other administrative authorities if it is necessary to ensure integrated management of user information between the system and sites of other administrative authorities. 3. The system shall have a security system to protect personal information of users (including credit information in order to allow users to use the services in safe manner. Article 14 (Duties of Users) 1. Users must accurately enter required information in using the services. Also where there is a change(s) in the use information previously provided, Users must immediately make the change(s) and manage information to maintain accurate information. Users shall not allow a third party to use or divulge their input numbers and passport numbers (or dates of birth). 2. Users shall not engage in any profitable activity in using the system services other than such activities other than those activities allowed under the Act on the Prevention and Management of Infectious Diseases and the Quarantine Act. 3. Users shall not engage in any activity described in each of the following paragraphs with respect to use of the system services: 1) Wrongfully use input another user input number and passport number (or date of birth), vaccination certificate, written confirmation for negative PCR test result, quarantine exemption statement, etc. by illegally using them or entering false information; 2) Sending, posting, publishing, transmitting by e-mail or other means any content that infringes upon the privacy of third parties or undermines the reputation of third parties, such as using or giving abusive language, slander, obscenity, insults, threats, disseminating false information, or specifying personal information of third parties; 3) Disguising sources of materials; 4) Posting, publishing, transmitting by e-mail or other means any content that may not be used under relevant laws or these general terms and conditions; 5) Posting, publishing, transmitting by e-mail or other means any content that infringes upon a third party patents, trademarks, trade secrets, copyrights, or other intellectual property rights; 6) Posting, publishing, transmitting by e-mail or other means any form of solicitations not approved by the Korea Disease Control and Prevention Agency, such as advertisements, spam mails, and chain letters; 7) Collecting or distributing a third party personal information; 8) Hacking or spreading computer viruses; 9) Impersonating the system administrators, employees, or related parties; 10) Arbitrarily changing all or some of the information posted on the system; 11) Engaging in any activity for the purpose of criminal activities or relating to other criminal activities; 12) Engaging in any activity that undermines public morals or social order; 13) Engaging in any activity that harm or insults a third party reputations; 14) Repeatedly sending advertising content against a third party intention; 15) Engaging in any activity that does or is likely to disrupt stable operations of the services; 16) Engaging in any activity that violates these general terms and conditions or other relevant provisions or use conditions specified in the system; or 17) Otherwise engaging in any activity that contravene relevant laws. Chapter 4. Other Provisions Article 15 (Copyrights to Posted Materials) 1. Users may not use or provide for profit-making purposes any material that they have obtained by using the system services, by processing or selling it, and any matter on copyrights to posted materials shall be subject to relevant laws. 2. Users shall solely assume any civil and criminal responsibility that occurs as a result of their posted materials’ infringing upon a third party’s copyrights. Article 16 (Ownership to System and Prohibition of Assignment) 1. Intellectual property rights and other rights relating to the services, software, images, marks, logos, designs, service names, information and trademarks, etc. provided by the system shall be under the ownership of the system. 2. Except for cases expressly approved by the system, users may not change, lend, borrow, sell, distribute, assign, sublicense, establish security rights, or commercially use all or some of each property in Section 1 above nor shall they allow a third party to do so. Article 17 (Compensation for Damages) The system shall not be held responsible for any damage incurred to users with respect to the services provided, except for criminal activities intentionally committed by the system. Article 18 (Exemptions) 1. The system shall be exempted from liability if it is unable to provide the services due to natural disasters or other commensurate force majeure events. 2. The system shall be exempted from liability for any damage incurred as a result of a key telecommunications service provider suspending or failure to normally provide telecommunication services; 3. The system shall be exempted from liability for any damage incurred due to unavoidable reasons, such as repair, replacement, regular inspection, and construction of service facilities. 4. The system shall not be held responsible for any damage incurred due to reasons attributable to users. 5. The system shall not have any obligation to represent any opinion or information of users expressed on the services. 6. Under no circumstances shall the system be held liable for any gain or loss obtained or suffered by users in reliance on the information contained in the services provided by the system. 7. The system shall not be held responsible for goods transactions or monetary transactions made through the services between users or between a user and a third party. Article 19 (Court of Competent Jurisdiction) Any dispute relating to use of the services that has occurred between the system and users shall be governed by the laws of the Republic of Korea. Any lawsuit arising under such a dispute shall be brought to a relevant court of competent jurisdiction under the Civil Procedure Act. Supplementary Rules (Date of Implementation) These general terms and conditions shall be implemented from February 15, 2022.
